Can someone have capacity to make some health and welfare decisions but not others?
Yes. Mental capacity is decision-specific. A person may have the capacity to make certain health and welfare decisions, such as choosing what to wear or where to live, but lack the capacity to make more complex decisions about medical treatment or care arrangements. Each decision must be assessed individually.
Can a health and welfare capacity assessment be used in Court proceedings?
Yes. Our reports are prepared in line with the Mental Capacity Act 2005 and can be used in Court of Protection proceedings, deputyship applications, safeguarding matters, and solicitor-led cases where evidence of capacity is required.
How long does a health and welfare capacity assessment take?
Most assessments take between one and two hours, depending on the complexity of the decision and the individual’s communication needs. Our assessors work at the person’s pace and ensure they have every opportunity to demonstrate their understanding.
Can a person be reassessed if their circumstances change?
Yes. Mental capacity can change over time. A person who lacks capacity at one point may regain capacity following treatment, rehabilitation, or improvements in their condition. Equally, someone with a progressive condition may require reassessment if their abilities change significantly.
