This service is included in all our LPA mental capacity assessments. If the person being assessed is deemed to have the capacity to appoint an attorney under an LPA, our assessor can act as the certificate provider on the same day as the assessment. There are no extra charges for this service.

Can the same assessment cover both Property and Financial Affairs and Health and Welfare LPAs?
If an individual wishes to create both types of Lasting Power of Attorney, the assessor can explore their understanding of each set of powers and responsibilities during the same appointment. However, each type of LPA must still be considered separately because they relate to different decisions. Therefore, setting up both types of LPAs counts as two separate assessments.
Can a capacity assessment be arranged if there are concerns about a future challenge to the LPA?
Yes. Solicitors and families sometimes request an independent assessment where they anticipate concerns about the donor’s capacity or the possibility of the LPA being challenged in the future. A contemporaneous assessment can provide valuable evidence regarding the donor’s understanding at the time the LPA was created.
What is the difference between being a Certificate Provider and a mental capacity assessor?
A Certificate Provider confirms that the donor understands the purpose and effect of the LPA and is not acting under pressure or being subjected to fraud. A mental capacity assessor conducts a formal assessment of the donor’s decision-making capacity. In some cases, OFH Care can provide both services during the same appointment.
Can concerns about undue influence be identified during an LPA assessment?
Yes. Part of the assessment process involves ensuring that the donor is making the decision freely and voluntarily. If concerns arise that someone may be exerting pressure or influence over the donor’s decision, these issues will be explored and documented appropriately.
Can someone have capacity to appoint an attorney even if they need help managing daily affairs?
Yes. The ability to appoint an attorney is different from the ability to manage day-to-day finances, healthcare decisions, or complex legal matters. The assessment focuses specifically on whether the donor understands the nature and effect of granting authority to another person through a Lasting Power of Attorney.
